Prenuptial Agreements

A well-drafted prenuptial agreement protects both parties and prevents future disputes. We advise you in negotiating and drafting agreements that protect your assets, inheritances, and rights, meeting all Florida legal requirements for full validity.

  • Pre-marital debts
  • Review of existing drafts

Frequently Asked Questions

The timeline varies depending on the type of adoption. Adopting a child from the foster care system can take 6 to 18 months. A private or stepparent adoption is usually faster — between 3 and 6 months — depending on the circumstances and court availability.

A protective order (injunction for protection) is a court order that prohibits a person from approaching or contacting the victim. You may need one if you have been a victim of domestic violence, harassment, stalking, or sexual assault. In Florida you can apply without an attorney, but legal representation significantly increases your chances of success.

Yes. Florida recognizes prenuptial agreements (premarital agreements) if both parties signed voluntarily, with full disclosure of assets, and without coercion. They must be in writing and signed before the marriage.

Generally the biological parent's consent is required. However, if the biological parent has abandoned the child (no contact and no support payments for more than one year), the court may proceed without their consent. Each case is unique and requires a legal evaluation.

It is not mandatory, but it is highly recommended. An attorney helps you file the petition correctly, gather evidence, prepare for the hearing, and respond to any objections from the respondent. Legal representation considerably increases the likelihood of obtaining and maintaining protection.
